General Terms and Conditions for the Use of the king club Membership

1. Scope and Subject Matter of the Contract

(1) These General Terms and Conditions apply to the use of the king club Membership (“Membership”), a benefits and loyalty program of P24 GmbH, Kapuzinerstr. 4, 94032 Passau, Deutschland.

(2) The Membership constitutes an independent contractual relationship, separate from the use of a physical or virtual card via the kingpay product. A king club Membership is not a payment instrument.

2. Description of Services

(1) The Membership provides registered users with access to the following services:
(a) Purchase of digital gift cards (e-gift cards) from selected providers,
(b) Use of exclusive offers and discounts from cooperating partner companies,
(c) Participation in the king coins bonus program.

(2) king coins can be collected through certain activities, such as the purchase of products or the use of offers, and redeemed for benefits within the system. Details of the collection and redemption system are described in the participation terms for king coins.

(3) The king club Membership is a closed system accessible only to registered users within the corresponding app. king coins are non-transferable, non-inheritable, and cannot be exchanged or paid out as legal tender.

3. Requirements and Use

(1) Use of the Membership requires registration in the designated king club app. Use is only permitted by persons of legal age.

(2) The user agrees to store their login credentials carefully and to use the Membership solely on a personal basis.

(3) There is no entitlement to participate in the Membership. P24 reserves the right to discontinue or modify the Membership or individual functions at any time, provided that no significant disadvantages arise for the user as a result.

4. Fees

(1) The use of the membership is free of charge. No fees are charged upon registration or during the term.

(2) Additional premium features may be subject to a fee and will be marked accordingly in the king club app.

5. Data Protection
(1) P24 processes users’ personal data exclusively for the purpose of providing the king club membership. The legal basis is Art. 6(1)(b) GDPR.

(2) Further information on the processing of personal data is available at https://www.kingcard.eu/datenschutz. Supplementary information on individual offers or partner companies can be viewed within the king club app.

(3) Personal data is only shared with partner companies to the extent necessary to provide individual membership services.

6. Liability

(1) P24 is liable for damages arising from the use of the king club membership only in cases of intent or gross negligence.

(2) The respective partner company is solely responsible for content or products made available within the king club membership.

7. Termination of Membership

(1) The king club membership can be terminated by the user at any time at the end of a month without notice via the king club app.

(2) P24 may discontinue the membership program in its entirety with two months’ notice. Users will be informed in text form.

8. Final Provisions

(1) These Terms and Conditions are governed by the laws of the Federal Republic of Germany. The place of jurisdiction for disputes arising from this contract is, to the extent legally permissible, the registered office of P24.

(2) If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
